Complaint against von der Leyen ruled inadmissible

As Ursula von der Leyen heads to Davos, the Indictments Chamber in Liège has just declared inadmissible the original civil-party complaint lodged by Mr Frédéric Baldan against the President of the Commission, which also makes that of Notre Bon Droit inadmissible. This decision raises questions about the rule of law and the ability of the justice system to uphold the integrity of our leaders.
Below we publish the press releases of Frédéric Baldan and of Notre Bon Droit.

URSULA VON DER LEYEN’S IMPUNITY ORGANISED: A REFUSAL TO RULE ON THE MERITS DESPITE THE FACTS

The facts are established, but the courts are refusing to rule on the merits of the case:

As a result, Mrs Ursula von der Leyen enjoys impunity. Offences were indeed committed, but apparently no one can ask for them to be prosecuted or punished. By declining to take up the case, the justice system shows that the Union has today become an area of unfreedom, insecurity and injustice.

A violent denial of the rule of law, democracy and fundamental rights:

By stating that “ the violation of a right, even one considered fundamental, does not necessarily imply the corresponding existence of damage on the part of the person invoking it ”, the Liège Indictments Chamber has seriously undermined the effectiveness of human rights. This decision runs counter to the case law of the European Court of Human Rights (ECHR) and is, moreover, incomprehensible in the light of the Belgian Criminal Code, which does punish arbitrary infringements of the rights guaranteed by the Constitution.

The Belgian courts have created two classes of citizens:

First, that of Mrs von der Leyen, who can commit offences without the courts bothering to prosecute them, and then that of all other Europeans, reduced to the status of second-class citizens deprived of the exercise of their rights. This may be why Emily O’Reilly, the European Ombudsman, having herself noted the destruction of human rights within the institutions, described the European Commission as an organisation similar to the mafia.

This procedure has produced important interim victories:

  1. We obtained the uncensored copy of the Pfizer contract, and did so legally;
  2. We have the investigation report of the Belgian Federal Police;
  3. We can now demonstrate that offences were indeed committed;
  4. We are no longer bound by the secrecy of the investigation.

We will continue the proceedings against Mrs von der Leyen:

We will force the return of democracy, enforce the rule of law, restore fundamental rights, and will not let corruption go unpunished.

The only effect of the ruling is to allow Mrs von der Leyen temporarily to escape justice, symbolically on the very day Anthony Fauci was granted a pre-emptive presidential pardon for his crimes.

Decision of the Indictments Chamber concerning the non-profit Notre Bon Droit and the civil parties it represents

On 20 January 2025, the Indictments Chamber handed down a decision declaring inadmissible the original civil-party complaint of Mr Frédéric Baldan, to which our own civil-party complaint was linked. This decision makes our own civil-party complaint inadmissible.

The reasoning of this ruling contains a particularly worrying element: according to the Indictments Chamber, the violation of a fundamental right does not necessarily lead to personal harm. Moreover, according to the Indictments Chamber, citizens are not directly harmed by offences such as corruption or illegal taking of interest, because the harm would primarily affect the State budget and not citizens’ wallets.

This position raises major questions about the effectiveness of the protection of fundamental rights in our State governed by the rule of law. It raises questions about how the indirect but very real impacts of such offences on citizens and on society as a whole are disregarded.

Despite this decision, the non-profit Notre Bon Droit reaffirms its unwavering commitment to defending fundamental rights and guaranteeing their full and complete protection.
